Agreement to Terms

By accessing or using TravelMap, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this platform.

Acceptable Use

You agree to:

  • Provide accurate and truthful information
  • Maintain the security of your account credentials
  • Use the platform for lawful purposes only
  • Respect other users and their content
  • Comply with all applicable laws and regulations

You agree NOT to:

  • Post false, misleading, or deceptive content
  • Harass, abuse, bully, threaten, or harm other users
  • Post content that doxxes, stalks, or exposes private information of others
  • Post or transmit child sexual abuse material (CSAM) or any content sexualizing minors
  • Use the platform for spam, phishing, or unsolicited commercial messages
  • Upload malicious code, viruses, or any software intended to disrupt the platform
  • Attempt to gain unauthorized access to the platform, its servers, or other users' accounts
  • Scrape, crawl, or harvest data without express written permission
  • Impersonate others or misrepresent your identity or affiliation
  • Violate intellectual property rights of TravelMap or any third party
  • Use the platform to facilitate illegal activity, including fraud or money laundering
  • Circumvent, disable, or interfere with security-related features of the platform

User Content

Your Rights

You retain all ownership rights to the content you post on TravelMap (trips, photos, descriptions, comments). You are responsible for ensuring you have the necessary rights to share this content.

License to TravelMap

By posting content, you grant TravelMap a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the platform and in connection with our services. This license ends when you delete your content or account.

Content Moderation

We reserve the right to remove content that violates these terms or our community guidelines. We may also suspend or terminate accounts that repeatedly violate our policies.

Privacy Settings

You can control the visibility of your trips through privacy settings:

  • Private: Only you can see the trip
  • Friends-Only: Only users you follow can see the trip
  • Public: Anyone can view the trip

Account Termination

You may delete your account at any time through your settings. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a security risk.

Disclaimers

Service Availability: TravelMap is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or error-free operation.

Travel Information: While we strive for accuracy, TravelMap does not provide travel advice. Always verify travel information with official sources and consult professionals for travel planning.

Third-Party Content: We are not responsible for content posted by other users or links to external websites.

Limitation of Liability

To the maximum extent permitted by law, TravelMap and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising from your use of the platform.

Intellectual Property

The TravelMap platform, including its design, features, and functionality, is owned by APF Labs and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform without explicit permission.

Changes to Terms

We may modify these Terms of Service at any time. We will notify users of significant changes via email or platform notification. Your continued use after changes constitutes acceptance of the updated terms.

Age Requirements and Parental Consent

You must be at least 13 years old to use TravelMap. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use TravelMap with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using TravelMap as a minor, you represent that you have obtained parental or guardian consent. We reserve the right to request proof of such consent at any time.

Subscription and Fees

TravelMap is currently free to use. However, we reserve the right to introduce paid features, subscriptions, or premium services in the future. If we do:

  • We will provide advance notice of any pricing changes
  • You will have the option to accept or decline paid features
  • Existing features may remain free or transition to paid tiers
  • All fees are non-refundable unless otherwise stated
  • Prices are subject to change with notice

Indemnification

You agree to indemnify, defend, and hold harmless TravelMap, APF Labs, and our affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content posted on the platform
  • Any negligent or wrongful conduct

Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us at labs@apf.cloud to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. You waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Either party may seek injunctive relief in court to prevent infringement of intellectual property rights or unauthorized access to the platform.

AI-Powered Features

TravelMap includes AI-powered features, such as itinerary suggestions and travel recommendations. By using these features, you acknowledge and agree that:

  • Not Professional Advice: AI-generated suggestions are for informational purposes only and do not constitute professional travel, legal, medical, financial, or safety advice. Always verify information with official sources before making travel decisions.
  • Accuracy Not Guaranteed: AI outputs may be inaccurate, incomplete, or outdated. We make no warranties regarding the accuracy or reliability of AI-generated content.
  • Content You Submit to AI: Trip details, destinations, and prompts you submit to AI features may be processed by third-party AI providers. We do not use your content to train AI models without your explicit consent.
  • Human Review: AI-generated suggestions are not reviewed by a human before delivery. You are responsible for evaluating and acting on any AI output.
  • No Autonomous Actions: AI features on TravelMap are assistive only and do not take actions on your behalf without your explicit direction.

DMCA and Copyright Takedown Policy

TravelMap respects intellectual property rights. If you believe content on the platform infringes your copyright, you may submit a takedown notice pursuant to the Digital Millennium Copyright Act (DMCA).

Your notice must include:

  • Your physical or electronic signature
  • Identification of the copyrighted work you claim has been infringed
  • Identification of the infringing material and its location on the platform
  • Your contact information (address, phone, email)
  • A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Send DMCA notices to: labs@apf.cloud with the subject line "DMCA Takedown Request". Repeat infringers will have their accounts terminated.

Account Suspension and Appeals

Grounds for Suspension or Termination

We may suspend or terminate your account immediately and without prior notice if you violate these Terms, engage in fraudulent activity, pose a security risk, or repeatedly infringe the rights of others.

Appealing a Suspension

If you believe your account was suspended in error, you may submit an appeal within 30 days of the suspension by emailing labs@apf.cloud with the subject line "Account Suspension Appeal". Include your account email and a description of why you believe the suspension was made in error. We will review your appeal and respond within 14 business days. Our decision on appeals is final.

Effect of Termination

Upon account termination, your right to use the platform ceases immediately. Your public content may be removed at our discretion. Sections of these Terms that by their nature should survive will remain in effect.

Beta Features and Experimental Services

TravelMap may offer features or services designated as "beta," "experimental," "preview," or "early access." These features:

  • May not be fully tested and may contain bugs or errors
  • May change significantly or be discontinued at any time without notice
  • Are provided "as is" with no warranties or guarantees of availability
  • Should not be relied upon for critical travel planning or decisions
  • May have limited support compared to production features

Your use of beta features is at your own risk. Feedback you provide about beta features may be used to improve our services without obligation to you.

API Usage and Developer Terms

If TravelMap provides an API or developer tools, additional terms apply:

  • You must comply with rate limits and usage restrictions
  • You may not use the API to replicate core functionality
  • API access may be revoked for violations or abuse
  • You must properly attribute TravelMap when using our API
  • API terms may be updated separately from these Terms

Export Controls and Sanctions

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any government list of prohibited or restricted parties.

Force Majeure

TravelMap shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms to any affiliate, subsidiary, or successor in interest without restriction. Any attempted assignment in violation of this section is void.

Severability and Waiver

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. Any waiver must be in writing and signed by us.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us, constitute the entire agreement between you and TravelMap regarding your use of the platform. They supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.

Survival

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, limitations of liability, dispute resolution, and governing law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. You agree that any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.

If you are accessing TravelMap from outside the United States, you are responsible for compliance with local laws. Nothing in these Terms limits our right to seek injunctive or other equitable relief in any jurisdiction.
